  • ABSCH-MSR-KR-247008-2 Legislative, Administrative or Policy Measure The Act on Access to and Utilization of Genetic Resources and Benefit-Sharing
    The purpose of this Act is to provide for necessary matters for implementing the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity; and for those for promoting the fair and equitable sharing of the benefits arising from accessing and using genetic resources and traditional knowledge associated with genetic resources, thereby contributing to the conservation and sustainable use of biological diversity, improving the lives of the people, and promoting international cooperation.
  • ABSCH-MSR-KR-247112-2 Legislative, Administrative or Policy Measure Enforcement Decree of the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing
    This Enforcement Decree is Presidential Decree in order to prescribe matters delegated by the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing and matters necessary for the enforcement thereof.
  • ABSCH-MSR-KR-247114-1 Legislative, Administrative or Policy Measure Enforcement Rule of the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing
    This Enforcement Rule is Ordinance of the Ministry of Environment in order to prescribe matters delegated by the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing and its Enforcement Decree and matters necessary for the enforcement thereof.
  • ABSCH-MSR-KR-248199-1 Legislative, Administrative or Policy Measure Public Notice on Exemptions from Reporting Access to Domestic Genetic Resource(s)
    The purpose of this Public Notice is to prescribe the cases where the head of the Competent National Authority may seek to simplify procedures for reporting access to genetic resource(s) or waive such reporting under Article 10 of the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing and Article 5(2) of the Enforcement Decree of the Act.
<Duties of the Competent National Authority>
Article 8 (2) of the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing and Article 3 of Enforcement Decree of the Act on Access to and Utilization of Genetic Resources and Benefit-Sharing prescribe the duties of the head of the Competent National Authority as follows:
  1. Processing a report on access or a report on changes in accordance with Article 9 of the Act;
  2. Prohibiting or restricting access to and utilization of domestic genetic resource(s) in accordance with Article 12 (1) of the Act;
  3. Supporting the fair and equitable sharing of benefits arising from domestic genetic resource(s);
  4. Investigating and managing the current status of utilizing domestic genetic resource(s);
  5. Investigating and managing the establishment of the agreement on sharing benefits from domestic genetic resource(s) pursuant to Article 11 of the Act and the implementation status thereof.
Summary of ABS Responsibilities
The field of jurisdiction of the Ministry of Agriculture, Food and Rural Affairs is "Agricultural bio-resources in accordance with the Act on the Conservation, Management, and Use of Agricultural Bio-Resources".

<Delegation of Authority>

In accordance with Article 13 (1) 1 of the Enforcement Decree, the Minister of Agriculture, Food and Rural Affairs, as the head of the Competent National Authority, delegates authority (excluding the authority in matters related to forest bio-resources and microbial pathogen resources of “agricultural bio-resources” defined in subparagraph 1 of Article 2 of Act on the Conservation, Management, and Use of Agricultural Bio-Resources) over the following matters to the Administrator of Rural Development Administration pursuant to Article 23 (1) of the Act: 
  1. Supporting the fair and equitable sharing of benefits arising from domestic genetic resource(s) under Article 8 (2) 3 of the Act;
  2. Processing access reporting or reporting on changes for domestic genetic resource(s) under Article 9 of the Act;
  3. Prohibiting or restricting access to and utilization of domestic genetic resource(s) under Article 12 of the Act;
  4. Imposing and collecting administrative fines pursuant to Article 28 (1) 1 and Article 28 (2) of the Act;
  5. Investigating and managing the current status of utilizing genetic resource(s) under subparagraph 1 of Article 3;
  6. Investigating and managing the establishment of mutually agreed terms on domestic genetic resource(s) and the implementation status thereof under subparagraph 2 of Article 3.

In accordance with Article 13 (2) 1 of the Enforcement Decree, the Minister of Agriculture, Food and Rural Affairs, as the head of the Competent National Authority, delegates authority (the authority in matters related to forest bio-resources and microbial pathogen resources of “agricultural bio-resources” defined in subparagraph 1 of Article 2 of Act on the Conservation, Management, and Use of Agricultural Bio-Resources) over the following matters to the Minister of the Korea Forest Service pursuant to Article 23 (1) of the Act:
  1. Supporting the fair and equitable sharing of benefits arising from domestic genetic resource(s) under Article 8 (2) 3 of the Act;
  2. Processing access reporting or reporting on changes for domestic genetic resource(s) under Article 9 of the Act;
  3. Prohibiting or restricting access to and utilization of domestic genetic resource(s) under Article 12 of the Act;
  4. Imposing and collecting administrative fines pursuant to Article 28 (1) 1 and Article 28 (2) of the Act;
  5. Investigating and managing the current status of utilizing genetic resource(s) under subparagraph 1 of Article 3;
  6. Investigating and managing the establishment of mutually agreed terms on domestic genetic resource(s) and the implementation status thereof under subparagraph 2 of Article 3.

In accordance with Article 13 (3) 1 of the Enforcement Decree, the Minister of Agriculture, Food and Rural Affairs, as the head of the Competent National Authority, delegates authority (the authority in matters related to microbial pathogen resources of “agricultural bio-resources” defined in subparagraph 1 of Article 2 of Act on the Conservation, Management, and Use of Agricultural Bio-Resources) over the following matters to the Commissioner of the Animal and Plant Quarantine Agency pursuant to Article 23 (1) of the Act:
  1. Supporting the fair and equitable sharing of benefits arising from domestic genetic resource(s) under Article 8 (2) 3 of the Act;
  2. Processing access reporting or reporting on changes for domestic genetic resource(s) under Article 9 of the Act;
  3. Prohibiting or restricting access to and utilization of domestic genetic resource(s) under Article 12 of the Act;
  4. Imposing and collecting administrative fines pursuant to Article 28 (1) 1 and Article 28 (2) of the Act;
  5. Investigating and managing the current status of utilizing genetic resource(s) under subparagraph 1 of Article 3;
  6. Investigating and managing the establishment of mutually agreed terms on domestic genetic resource(s) and the implementation status thereof under subparagraph 2 of Article 3.
